Under Article 212 of the Constitution of Pakistan, 1973, a Federal Service Tribunal was established to adjudicate on matters relating to the terms and conditions of civil servants. The Tribunal is the only body with the authority to hear such cases. The establishment of the Tribunal has as its primary goal the provision of an independent and autonomous forum for adjudication of disputes relating to the conditions of service of persons serving in the Pakistani Armed Forces.
The Tribunal has its headquarters in Islamabad and two Camp Offices in Lahore and Karachi, as well as a number of regional offices. An Honorable Chairman (a retired High Court judge) and Members appointed by the President who are experienced administrators, district and session judges, or senior advocates of the High Court and above serve as the Tribunal’s leadership.
The Tribunal does not charge any fees to the appellants or Civil Servants for the filing of an appeal or other documents with the Tribunal. The appellants, on the other hand, are charging a nominal amount of Rs.100/- as Cash Security and Rs.60/- per respondent as Cost of Service, out of which Rs.100/- is refundable to the appellants following the final decision of their appeals.
Judgments are also being sent to the appellants at no charge to their residential address, which has been provided by the appellants. As a copying fee, the applicants will be charged Rs.1/- per page for providing certified copies of their applications. The right to argue their cases without the assistance of an attorney is also granted to appellants in some circumstances.
Since its inception, the Tribunal has demonstrated its effectiveness and utility by providing relief against the arbitrary and capricious exercise of administrative power by the authorities against subordinate civil servants and by protecting their rights.
